Terms of Service

SwimData is a service of “SwimData For Internet Content Provider”, a sole establishment licensed in Dubai, United Arab Emirates under eTrader (Trader Licence) number 1650995, issued by the Department of Economy and Tourism, Dubai.

You can check the licence on the Department of Economy and Tourism, Dubai register. References to "we", "us", and "our" in these Terms mean that business, which is the party you contract with.

You must be at least 18 years old to create an account. You represent that information you provide is accurate and that you have permission to add any swimmer profiles you create (including minors you coach or parent).

• Keep your login credentials confidential.
• You are responsible for activity under your account.
• Choose an appropriate account role (swimmer 18+, parent/guardian, or coach) and use display names for athletes where possible.
• Notify us promptly if you suspect unauthorized access.

You are responsible for the accuracy of times, dates, and profile information you enter or upload. SwimData provides analytics and educational insights; it does not replace professional coaching, medical advice, or federation eligibility decisions.

Do not upload unlawful content or data you are not entitled to use. Do not enter another person's full legal identity without a lawful basis and, where they are a child, appropriate parental or guardian authority.

Some features use automated analysis. Outputs may be incomplete or incorrect. You should verify important decisions with qualified coaches or officials. We do not guarantee the accuracy of AI interpretations, benchmarks, or projections.

You agree not to:

• Attempt to breach security or access other users' data
• Use the service for spam, harassment, or illegal purposes
• Reverse engineer or overload the platform without permission
• Resell or misrepresent the service as your own product

We own the SwimData software, branding, and documentation. You retain ownership of data you submit. You grant us a limited licence to host, process, and display your data solely to operate and improve the service for you.

We aim for reliable service but do not guarantee uninterrupted access. We may modify features, suspend access for maintenance, or discontinue parts of the service with reasonable notice where practicable.

SwimData is not affiliated with, endorsed by, or sponsored by Swim England, Aquatics GB, USA Swimming, Swimming Australia, UAE Swimming Federation, UAE Aquatics, apexsports.ae, or SwimCloud. Reference times, frameworks, and standards are used for analytical and educational purposes only.

WHOOP is a registered trademark of WHOOP, Inc. All data retrieved via the WHOOP API is done so with explicit user authorization in compliance with WHOOP's Developer Terms.

Names of governing bodies, programmes, and standards tables appear inSwimData for descriptive and benchmarking purposes only. We do not represent any third-party organisation or speak on its behalf.

The service is provided "as is" and "as available" to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill arising from your use of SwimData. Our total liability for any claim relating to the service is limited to the greater of (a) amounts you paid us in the twelve months before the claim, or (b) one hundred US dollars, except where liability cannot be limited by law.

You may stop using the service at any time. We may suspend or terminate accounts that violate these Terms or pose a security risk. On termination, your right to use the service ends; data handling is described in our Privacy Policy.

SwimData is free to use while in beta. Paid subscriptions are not yet active, and we will not start charging an existing account without telling you first.

When a paid subscription is available and you choose one, the price and currency shown before you confirm is the total amount payable, and the subscription is billed in advance for each period.

• You can cancel at any time from your account settings. Access continues to the end of the period you have paid for, and you are not charged again.
• Because SwimData is a digital service, there is nothing to return or exchange, and part-used periods are not refunded on cancellation.
• If you were charged in error, charged twice, or the service was unavailable for a material part of a period you paid for, email us within 14 days of the charge and we will review it and refund where due.

Mandatory consumer rights under the law of your country of residence are not affected by anything in this section.

These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, without regard to conflict-of-law rules. The courts of Dubai have exclusive venue for disputes, unless mandatory consumer protections in your country of residence require otherwise.
